Conditions of use

These conditions of sale are concluded on the one hand by the Enigma Miniatures, headquartered in Mijas Costa - Málaga (29649) SPAIN, and secondly, by any person or entity wishing to make a purchase via the website of "Enigma Miniatures" hereinafter referred to as "the purchaser".

Scope

These conditions of sale’s aim is to define the contractual relationship between ENIGMA MINIATURES and the purchaser and the terms applicable to all purchases made through the ENIGMA MINIATURES merchant site, the buyer being either professional or final consumer.

The acquisition of a good or service through this site implies acceptance by the buyer of these conditions of sale.
These conditions shall prevail over any other general or specific conditions not specifically approved by ENIGMA MINIATURES.
ENIGMA MINIATURES reserves the right to modify these conditions of sale at any time, without prior warning. In this case, the applicable conditions will be those in place at the order date.

Characteristics of offered goods and services

The products and services offered are those listed in the catalog published in the website ENIGMA MINIATURES.
These products and services are offered within the limits of available stocks.
Each product is accompanied by a description.
The photographs show the assembled and painted product as an example. The products are sold unassembled and unpainted, unless specifically mentioned otherwise. The scenery elements, paint and glue are not provided.

Price

The prices listed in the catalog are final prices in euros taking into account the spanish VAT applicable on the date of the order. Any change of the VAT rate may be reflected in the price of the goods or services.
ENIGMA MINIATURES reserves the right to modify its prices at any time, except that the prices contained in the catalog on the day of the order shall be applicable only to the buyer.
Prices quoted do not include the costs of order processing, transportation and delivery.

Orders

The buyer, who wishes to buy a product or service must:
- Create an account on the site by filling all the requested data;
- Constitute his basket;
- Validate the order after having checked its contents;
- Make the payment according to the terms and the selected payment method.
Payment of the order implies acceptance of these terms of sale, the recognition of having perfect knowledge and to forego other conditions of purchase or other conditions.
All the data that are recorded and the payment will be worth proof of the transaction. The payment will be worth signing and acceptance of transactions.
The seller will email the confirmation of the order.

Retractation

The buyers, whether professional or non-professional individuals, have a period of seven days from the delivery of their orders to return to the seller the product for exchange or refund without penalty, except for the return charges.

Payment terms

The price is payable on order completion.
Payments can be made either:
- By credit card: these payments will be made through Paypal which uses secure SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and no third party can read it during the transport on the network.
- Check
- By Money wire
In these 2 latter cases, the products will be shipped upon receipt of payment.
At the request of the buyer, he will be provided with an invoice indicating the VAT by email.

Delivery

Deliveries are made at the address indicated in "delivery address" of the customer profile.
The risks are borne by the purchaser at the time the goods have left the premises of ENIGMA MINIATURES. In case of damage during transport, the protest grounds must be made with the carrier within three days from delivery.
Delivery times are only an indication, if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Warranty

All products supplied by the seller have the legal guarantee provided by articles 1641 and following of the Civil Code.
In case of nonconformity of a sold product, it may be returned to the vendor who will take over, refund or exchange.
All claims, requests for exchange or refund must be made by email at: info@enigmaminiatures.com within thirty days of delivery.

Responsability

The seller, in the process of selling online is only bound by an obligation of means, his ressponsability can not be held liable for damages resulting from the use of the Internet such as data loss, hacking, viruses, or other unintended problems.

Intellectual property

All elements of the site ENIGMA MINIATURES are and remain the exclusive intellectual property of ENIGMA MINIATURES.
Nobody is allowed to reproduce, use, broadcast, or use for any purpose whatsoever, even partially, the elements of the site, whether software, visual or audio.
Any single link or hypertext is strictly prohibited without the express written consent of ENIGMA MINIATURES.

Personal data

According to the law relating to data, files and freedoms of January 6, 1978, the information relative to the buyers may be subject to automated processing.
ENIGMA MINIATURES reserves the right to collect information on buyers including using cookies, and, if desired, to transmit to trading partners the information collected.
Buyers may object to the disclosure of these details by notifying ENIGMA MINIATURES. Similarly, users have a right to access and correct data concerning them, according to the law of the 6 January 1978.
The processing of information, including management of email addresses of users of the site has been declared to the CNIL on 24/01/2008 registered under number 1273179.

Archive – proof of purchase

ENIGMA MINIATURES archive purchase orders and invoices on a reliable and durable physical support in accordance with Article 1348 of the Civil Code.
The registers of ENIGMA MINIATURES will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

Dispute resolution

These sales conditions are subject to spanish law.
In case of dispute, jurisdiction is assigned to the competent courts of Málaga.
